For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to www.floralimpressions.com.au and “You” and “Your” refers to you, the client, customer, visitor, website user or person using this website.

Consent

By accessing, using or browsing this website you agree to comply with and be bound by these terms and conditions and all other terms contained on this website. If you do not accept these Terms you should cease using this website. We will consider your choice to use this website as your explicit agreement of acceptance that these terms govern your and Floral Impressions rights and obligations to each other.

Amendment of terms

We reserve the right to alter, add or remove all or any part of these terms at any time. Please regularly refer to these terms to ensure you are aware of any changes as any changes may have an immediate affect when published on this website. Continued use of this website after amendments have been made will constitute your agreement to be bound by those amended terms and conditions. Where possible, we aim to bring to your attention any significant or substantive changes.

Limited liability

It is a mandatory condition before using our website that you agree and accept that Floral Impressions is not legally responsible for any loss or damage you might suffer related to your use of this website.
Your use of any information or materials on this website is entirely at your own risk and judgement, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

We will not accept liability to you in respect of any loss or damage (including indirect, special, or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of:

  1. (a)  Your use or misuse of this website;
  2. (b)  Any loss from your use, misuse or, reliance on or failure to act on, any information contained on or accessed through this

    website;

  3. (c)  Errors, mistakes or omissions on this website;
  4. (d)  Goods or services supplied in an order placed by you on this website; and/or
  5. (e)  Any failure or omission on our part to follow our obligations as set out in these Terms.

Contract of sale

A contract of sale for the purchase of goods will only occur at our discretion if we accept an order for goods from you. Acceptance of your order occurs when we have received your order completed in full and that we have processed a lawful tender for the full amount of that order, and we have verified your order to you by email, phone or otherwise.

Pricing

All prices on this website are quoted in Australian Dollars and include GST.
All prices quoted are exclusive of the cost of delivery or accessory or gift item(s) unless otherwise stated. The cost of delivery will be quoted at the checkout once you have provided us with the recipients correct delivery address.

Seasonality

By accepting these terms and conditions you acknowledge and accept that floral products sold on this website are a perishable, natural item and the life span of flowers is dependent on species, time of year and that proper care is taken of the finished product. You also acknowledge that some flowers are seasonal and may not be available at the time of ordering.
By accepting these terms and conditions you accept & acknowledge that seasonality may cause discrepancies between images on this website and produced goods.

Product

We make the best efforts to supply products that match the images and descriptions provided on the website as closely as possible. Subject to availability, and being a product of nature, you acknowledge and accept that minor variations between the images and descriptions provided on the website and the goods as delivered may occur.
You accept that where gifts and items are ordered (such as vases and other gift items) and are unavailable, a substitution of equal or greater value will be made by us and you will hold us harmless for any such variations.

From time to time, we may engage other florists to fulfil orders. You accept & acknowledge that that in such circumstances, variations between the images and descriptions provided on the website and the goods as delivered may occur, including but not limited to the use of gift wrapping and presentation. You agree to hold us harmless for any such variations.

Substitution

We take great pride in supplying & creating beautiful floral designs to the highest standards. It is important to remember that flowers are a product of nature. As such, availability of some varieties will be governed by seasonality and growing conditions. Adverse growing conditions can mean some varieties never grow in their season, and others varieties will only ever be available in their season (eg in the southern hemisphere, locally grown peonies are only available late spring). For these reasons, not all goods produced are as pictured on www.floralimpressions.com.au.

Our selection of arrangements contains varieties that are generally available most of the time. Seasonality and availability affects cost, and some flowers may be of different value at the time of production, and some flowers may not be available at certain times. In circumstances of difficult supply, we continue to seek to provide the highest quality product. There will be times when Our

Qualified Florists will use their discretion and substitute any unavailable flowers and foliage for the best alternative(s) available that are of a similar appearance and value. You agree to hold us harmless for any such variations.

Orders

By using this website to place your order, you acknowledge you are solely responsible for the information provided for each order placed is truthful and correct.

You must be over 18 years of age to use this website to purchase any alcohol products.

Provision of correct information

This means that you have carefully selected the item or items to be delivered and that all delivery details for that item or items are correct. It includes any detail we should know or should have known in order for us to accurately execute your order before your submitting and our accepting of your order or attempting delivery. Examples include, but are not limited to information such as the item or item(s) ordered and their quantities, card message(s), payment details, your contact number, recipient name, recipients contact number, recipient address, the card message, delivery time (am or pm only), whether or not the address is a business, hospital or private residence, locked gates or security entrances, apartment blocks, dogs, or prescribed safe place to leave. This is your responsibility.

Incorrect information can result in delays in delivery or additional charges.
In the event that any of such information is incorrect, and the order has been successfully processed, Floral Impressions will be held harmless by you for any action we take in delivering your order based upon the information you have supplied.

Specific requirements

If you have any specific requests for your order, please ensure that this information is completed in detail in the Additional Information Field before check out. In placing your order with us, you accept and take all responsibility that the correct delivery address is provided, and goods ordered are as intended by you. This is your responsibility.
Additional information can include, but is not limited to, recipient allergies, information about locked gates at the delivery address, specific details about where to leave a delivery if the recipient is not home, additional contact numbers for other persons who can assist in delivery if the recipient is not contactable. Failure to mention specific requirement can result in delivery delays and additional costs.

Floral Impressions will not be held liable for any loss in the event delivery is unsuccessful or that the delivery has been tampered with by an unknown party or parties.

Peak periods

We reserve the right, and at our own discretion, to not accept changes to any orders for delivery on special calendar events, including but not limited to Christmas, Valentine’s Day or Mother’s Day. At our own discretion we may also reject any order for goods where, for example, if we are unable to arrange delivery to the recipients address, or items for your order have sold out. In these and similar instances, we will notify you as soon as possible and will refund any amounts paid by you for those goods.

Cancellation & Changes

We reserve the right to reject changes to an order within 24 hours of the delivery date.
If, for any reason, you must make changes to an order, with exception to peak periods, this may be made by calling our store on (03) 9499 1000 to request the change no later than 24 hours before the delivery date.
Refunds can only be made back onto the credit card that was used for the original purchase.

Delivery

Floral Impressions will not be held responsible or provide a refund for any loss if, when acting in good faith, the delivery is unsuccessful, the address supplied on the order is incorrect or that the delivery has been tampered with by unknown party or
parties. At our sole discretion we will make delivery by a third party service, or use our own vehicle. Because each day is different, couriers will only leave with deliveries when sufficiently full. For this reason we can only offer AM or PM delivery.
If correct delivery information is not provided there can be delays in delivering or additional charges. Same day re-delivery cannot be guaranteed.
In the event delivery is assessed as safe to leave, and after taking a photo of where the goods where left, Floral Impressions will not be held liable or provide a refund or part thereof for any loss after the goods have been left in a safe place.
We use Google maps and Google Street View to verify all delivery addresses supplied.

Same-day delivery

Same day delivery within business hours is guaranteed for orders placed no later than 11am Monday to Friday. All other orders are guaranteed same day delivery by 7pm if placed no later than 12pm that day. Saturday delivery cut-off is 10am. Delivery outside of these hours is subject to availability. Please contact us on +61 3 9499 1000 if you require deliver outside of these hours.

Correct address

We will deliver the goods you have ordered to the delivery address you have specified when completing your transaction. This is your sole responsibility. You will hold us harmless if you provide an incorrect address, whether intentional or accidental.
If an incorrect address is provided by you and you request that your order be delivered to a different address, you will be responsible for any additional delivery charges. If the goods need to be re-produced and then re-delivered, you will be responsible for both re- production and re-delivery costs.
We use Google maps and Google Street View to verify all delivery addresses supplied.

Access

In providing the correct delivery address for the recipient, it is solely your responsibility to advise us of anything whatsoever that may impede an attempted delivery. This includes locked or locked gates, watch dogs, security entrances, apartment buildings, the availability of a concierge, or prescribed safe place to leave.

Safe to leave

We take no responsibility if no one is present at the delivery address to accept delivery on the delivery date specified on your order. When placing your order, must specify if goods are safe to leave. This is your responsibility. If we receive no such advice, we will use our sole discretion on whether or not the goods are safe to leave.
If the recipient is not present at the delivery address, the flowers will be left at the delivery address unless, in the courier’s opinion, it would not be safe to do so, in which case your goods will be returned to our store and we will attempt to contact you to advise you that your goods could not be delivered.

If your goods need to be re-delivered, you will be responsible for any additional re-delivery and any re-production costs.
In the event we have no alternative and provided that on our assessment it is safe to do so, the goods will be left at the delivery address. This is not an uncommon occurrence, and in the event that it may affect your delivery, we will take a photo showing the safe location it was left as proof of delivery.
In the event delivery is assessed as safe to leave, and after taking a photo of where the goods where left, Floral Impressions will no longer be held liable for any loss after they have been left in a safe place.

Non- Delivery

If the address to which the goods will be delivered is located in an area which are unable to or do not service, we will not execute your purchase, and we will attempt to contact you to resolve.
In the event, and for whatever reason, where we are unable to affect delivery, you will be contacted by us to seek your further instructions.

It is your sole responsibility to supply us with the correct delivery address. If you knowingly supply a delivery address outside our prescribed delivery area, you should contact us immediately after processing your online order to confirm delivery availability and associated costs.
If it is determined by using Google maps that the delivery address supplied may not be in the correct suburb, we will attempt to contact you to establish the correct location of the address.

Incorrect delivery address can delay delivery or result in additional costs.
We use Google maps and Google Street View to verify all delivery addresses supplied.

Re-production of arrangements

If the delivery cannot not be effected in person, and in the courier’s opinion it is not safe to leave the goods, your order will be returned to our store and we will attempt to contact you to advise of the failed attempt.
If you require your order to be re-delivered, you will be responsible for any additional costs to reproduce and/or redeliver the order. You will hold us harmless if no one is present at the delivery address to receive the goods or there being no reasonably safe place to leave the delivery.

Promotional codes

From time to time, we may advertise promotional codes, which provide discounts for orders placed online, excluding delivery charges.
Unless otherwise stated, all Coupons and Discount Codes issued by Floral Impressions are non-transferrable and non- exchangeable. If you use a coupon code which was not issued to you, and express written permission was not obtained from Floral Impressions, we reserve the right to modify or cancel a promotional code at any time without prior notice. If, in our sole opinion, and at the time the promotional code is or was not being used in a manner and for the purposes intended. In the event the discount code is used fraudulently, you acknowledge and accept the rights of Floral Impressions to charge you for the amount of the discount deceitfully obtained. If an on-line order in any way breaches the above under this clause, we reserve the right to, in our absolute sole discretion, and without prior warning, to declare the use of that code null and void.

Promotional codes
 Cannot be exchanged for the purchase of gift cards or gift vouchers or exchanged for any other goods.
 Cannot be used in conjunction with any other offers.
 May have an expiry date.
 Are not for in store use and can only be used for online purchases.
It is your responsibility to ensure that directions contained in the promotion T’s & C’s for use, collection and redemption of the promotional code are followed.
If you have difficulty redeeming a code for an online purchase, please contact the store on (03) 9499 1000.

Refunds

We will refund 100% of the purchase price paid if you cancel an order by calling our store no less than 24 hours prior to the delivery date.
Refund of any order cancelled within 24 hours of delivery or pick-up date will be negotiated on a case by case basis, taking into consideration our costs incurred and consideration of your circumstances. This may mean any refund given may be between a full to a partial refund. This will apply to specific items ordered but not shown on the website to everyday arrangements that are shown on the website. However, we do offer a full refund for cancellation within 24 hours of delivery or pick-up of a ’standard’ arrangement purchased online or in store.

Refunds for matters of quality are governed by Australian Consumer Law.
Refunds can only be made on the original credit card used for the original purchase.
Any refund issued may take up to 5 business days before you see it in your account. Please check with your bank to determine if the refund has been successful before contacting us.

Proper care

Provided your flowers are cared for correctly, you can generally expect them to last at least 7 days.
If flowers are not sent in a self contained water source such as a vase, we will preserve flowers sent by wet packing the arrangement in wet tissue to provide them with a source of moisture until delivered. You acknowledge that this may not be sufficient protection on hot days where the flowers are left in a safe location.
Following the steps listed below will help you ensure that your flowers last as long as possible:

  1. As soon as flowers are received, remove wet tissue paper.
  2. Stems should be cut on an angle by 2 to 2.5cm from the bottom of the stem (in or under running water if possible).
  3. Never untie the bouquet or posy. This will not only ruin their appearance, but also make them harder to care for.
  4. Always use a clean filled with fresh water.
  5. Always monitor the water level. Refill if necessary.
  6. Change the water every two days. Ensure the vase is cleaned between water changes, and is refilled with fresh water.
  7. Water additives are not recommended.
  8. Keep the flowers in a cool location with a stable temperature.
  9. Keep the flowers out of direct sunlight and other and sources of heat.
  10. Keep the flowers away from drafts and air-conditioning.

Quality

We take great care and go to lengths to ensure that the flowers we source are from the mode reputable vendors and where available, of the highest available premium quality.
You can generally expect most flower varieties to last at least 7 days provided they are correctly cared for. This is conditional on the care instructions provided in the message envelope with your flower delivery, or the instructions noted above.
However, in the event your flowers wilt within 3 days, and before we can determine the fault, we require some evidence of the problem. We ask that you:

  1. Call our store as soon as reasonably practicable to notify us of any such occasion; and
  2. Email digital photos of the flowers to flowers@floralimpressions.com.au and/or return the flowers to our store within a

    reasonable period of time after notifying us.

  3. Provide us with a copy of your purchase receipt.

Remedy

Once we are confident that your flowers have been cared for as recommended, we will happily replace the flowers. At our discretion we will do one the following:

  •   Provide you with a full refund, or
  •   Replace the arrangement or cut flowers with one that is the same or of equal value to the wilted one.
  •   If a part of the arrangement fails, then we will repair free of charge the part that has failed.
    If we provide you with replacement flowers, partial replacement or refund, then, subject to any statutory rights you may have (including under the Australian Consumer Law) which cannot be excluded, you then agree that we have completely discharged our obligations, and any and all liability we may have, to you, and hold us forever harmless.
    If we produced the incorrect goods, we will provide a replacement or gift certificate to the value of the order.
    Liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
    Remedies are governed by Australian Consumer Law. Any claim made in respect of goods or services supplied to you by us is limited to, and for the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3- 2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth).

    Change of mind

    We will not refund for change of mind or change of design or style.

    Complaints

    Any matter with which you may have concern can be addressed to us in writing by emailing flowers@floralimpressions.com.au. We will then review your feedback and respond accordingly in a reasonable period of time. It is our sole and express desire and preference that we are able to meet resolution of all complaints amicably and confidentially. We make no assurances that your concerns will be addressed properly and confidentially if you publish them as a review and in the public domain.

    Third party websites

    Links to other websites have been made by Floral Impressions to third parties who assist in us making online transactions. Third- party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
    Third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. To understand the manner in which your personal information will be handled by these providers, it is recommend that you read and familiarize yourself with that websites Terms & Conditions and their Privacy Policies before proceeding,

    This is important because certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. If you choose to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. For example, if you are located in Australia and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation.

Privacy

Floral Impressions is committed to protecting your privacy. Australian based secure servers used by this website protect all information we receive from our customers. You may change the details you have left with us at any time by advising us in writing via email. We respect all information received from our customers, which is protected by our Australian based secure servers. The Australian based secure server and its software encrypts all customer information before it is sent to us. Furthermore, all of the customer data collected by this website is secured against unauthorised use or access. We do not store credit card information on our servers.
The privacy and confidentiality of the information provided by you and adheres to the national privacy principles established pursuant to the Privacy Act 1988 (Commonwealth). Please read our separate Privacy Policy carefully.

Indemnity

You acknowledge and accept that your use of any information or materials on this website is entirely at your own risk and judgement. Flowers and foliage are not fit for human or animal consumption.

Force majeure
